CCF informs court of legality

Lawyers representing the Citizens' Constitutional Forum (CCF) yesterday informed the Fiji Court of Appeal all government actions must be authorised by law.
The Court of Appeal granted leave to CCF to appear as 'friend of the court' in the Fiji Court of Appeal case of Qarase vs Bainimarama and Others which began on Monday. Queen's Counsel (QC) Dr Melissa Perry and Nicola McGarrity who are representing CCF in their submission raised important constitutional and rule of law issues.

Dr Perry made submissions on the supremacy of the Constitution and the rule of law, which means all government action must be authorised by law.

"The Constitution creates, empowers and binds the institutions of government," said Dr Perry said.

Dr Perry raised the issues of the greatest public importance for the Constitution and the rule of law in Fiji, and has potentially far-reaching implications for the future government of Fiji

"CCF is here to assist the Court," she said.

Meanwhile CCF Chief Executive Officer Rev Akuila Yabaki said they were not supporting any party or any particular outcome for this case, they were the "Friend of the Court".
